SERVICE AGREEMENT

I understand that internetworking communications are not secure, and may be subject to interception or loss. LISCO makes no warranties of any kind, either express, implied, or statutory concerning the data or information available through the LISCO network.

I understand that the use of my LISCO account, and any data or information accessed using that account, will be completely at my own risk. I understand that the cumulative liability of LISCO for any and all claims relating to the services provided by LISCO, in contract, tort, or otherwise, shall not exceed the total amount of the basic service fees paid to LISCO for services within the prior year. I agree that LISCO shall have no liability for the services, data or information made available to me, including any liability for any consequential, indirect, special or incidental damages regardless of the success or effectiveness of other remedies.

I understand that the information available through LISCO or interconnecting networks may not be accurate. I understand that the some of the information available through LISCO or interconnecting networks may be intended for adult audiences.

I understand that violation of certain generally accepted guidelines on Internet usage, such as restrictions on mass e-mailings and mass advertising, or posting to inappropriate newsgroups, may cause severe operating difficulties for LISCO, and would be a likely cause for the termination of my account.  See LISCO's Appropriate Use Policy for more details about what is and is not appropiate usage.

I understand that LISCO's dial up Internet access is shared by other users and is not an individual connection for my exclusive use. LISCO attempts to maintain a ratio of customers and telephone lines that is generally consistent with industry standards. LISCO, at its discretion, may disconnect users who have been inactive for a period of time or who have been active for an extensive period of time.

I understand that a dial-up Internet service account is a shared resource. This system works only if people dial in, use the Internet for a while, and then log off when finished. If users stay connected even while they are not using the Internet, or for extraordinarily long periods of time, this ties up the lines and other users cannot get in. LISCO does not provide "unlimited" access for dial up accounts. Instead, it provides unmetered access.

I understand that unmetered access assumes that the people using the system are courteous to others and not wasteful of the common shared resource. LISCO maintains the right to discontinue service for customers who attempt to stay connected for extraordinarily long periods of time.

I understand that there are problems inherent with computer equipment, telephone lines and other devices necessary to use the Internet. LISCO warrants that it will maintain their equipment in working order but is not responsible for equipment failure or disruption of service. The customer will be billed a monthly fee and is responsible for that monthly fee in total. LISCO maintains the right to discontinue service for nonpayment of bills or any other reason they deem appropriate.
